NOTICE REGARDING RIGHT TO BENEFIT FROM
CLASS ACTION
A class action lawsuit was filed against Monarch Recovery Management, Inc. ("Monarch") related to debt collection letters used by Monarch. The Court has certified a class action comprised of certain individuals. You may be a member of the Class Action and entitled to payment as a result.
A Class Recovery Fund has not yet been established. The Court will decide what total damages, if any, to award the class, which funds will be used to pay valid claims. You may be entitled to a portion of the Class Recovery funds. The final cash payment for class members will depend on the total number of valid and timely claims filed by all Class Members, and the ultimate size of the Class Recovery Fund, still to be decided by the Court. Your legal rights are affected whether you act or don’t act. Read the notice carefully.
YOUR OPTIONS | |
Option 1: | Submit a claim form and receive the benefits from the Class. By submitting a claim form, you are agreeing to be a member of the Class and may receive a share of the Class Recovery funds, if any such funds are awarded by the Court. You will also be bound by the terms of the result in the Class Action, and will give up your right, if any, to sue on your own. |
Option 2: | Do nothing and receive no benefit from the Class Action. Instead of submitting a claim form, you may do nothing. By not submitting a claim form, you cannot recover as part of this Class Action, and you keep a right to sue on your own. By doing nothing, you will be excluded from the Class and will not be bound by the terms of the result in the Class Action. You will not receive a share of the Class Recovery funds, if any such funds are awarded by the Court. |
